DMCA Policy
1. Introduction and Policy Statement
FileFlows (“we,” “us,” or “our”) operates the website https://fileflows.in (the “Site”). We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, FileFlows will respond expeditiously to claims of copyright infringement committed using the Site if such claims are reported to our Designated Copyright Agent identified in the sample notice below.
If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent. Upon receipt of Notice as described below, FileFlows will take whatever action, in its sole discretion, it deems appropriate, including removal of or disabling access to the challenged material from the Site.
2. DMCA Notice of Alleged Infringement (“Notice”)
If you believe that your intellectual property rights have been violated by content present on FileFlows, please provide the following information to our Designated Copyright Agent. Your Notice must be in writing and must include the following distinct elements:
- Identification of the Copyrighted Work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works at a single online site are covered by a single notification, you may provide a representative list of such works at that site.
- Identification of the Infringing Material: A description of the material that you claim is infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled. You must provide information reasonably sufficient to permit us to locate the material. Ideally, this should include the specific URL(s) on
fileflows.inwhere the material is located. - Contact Information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted.
- Statement of Good Faith: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
3. Counter-Notification Procedures
If you believe that material you posted on the Site was removed or access to it was disabled by mistake or misidentification, you may file a Counter-Notification with us (a “Counter-Notice”). To be effective, a Counter-Notice must be a written communication provided to our Designated Agent that includes substantially the following:
- Identification of the Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- Statement of Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Contact Information: Your name, address, and telephone number.
- Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the United States, that you consent to jurisdiction of any judicial district in which the service provider may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Signature: Your physical or electronic signature.
If a Counter-Notice is received by our Designated Agent, FileFlows may send a copy of the Counter-Notice to the original complaining party informing them that we may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the Counter-Notice, at our sole discretion.
4. Repeat Infringer Policy
FileFlows does not tolerate copyright infringement. In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, access to the Service for users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
5. Misrepresentations
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. Liability may include damages, including costs and attorneys’ fees, incurred by the alleged infringer, by any copyright owner or copyright owner’s authorized licensee, or by a service provider (FileFlows), who is injured by such misrepresentation, as the result of the service provider relying upon such misrepresentation in removing or disabling access to the material or activity.
Therefore, if you are unsure whether the material you are reporting is in fact infringing, you may wish to contact an attorney before filing a notification with us.
6. Third-Party Content and Hosting
Please be aware that FileFlows.in is a directory and informational website. In many cases, the content (software, games, or applications) is not hosted directly on our servers but is linked to third-party servers or official developer repositories.
If the infringing content is hosted on a third-party server, identifying and removing the link from FileFlows will not remove the content from the source. We recommend that you also contact the administrator of the third-party site hosting the content to ensure its removal from the internet entirely.
7. Designated Copyright Agent Contact Information
All DMCA notices and counter-notices should be sent to our Designated Copyright Agent at the following address:
Email: dmca@fileflows.in Subject Line: DMCA Takedown Request – [Name of Content]
Please allow 2-5 business days for an email response. Note that emailing your complaint to other parties such as our Internet Service Provider will not expedite your request and may result in a delayed response due to the complaint not being filed properly.
If you believe that your content was removed in error, you may submit a counter-notification in accordance with the DMCA.
